Terms and Conditions

DEFINITIONS

“We”, “Us” and “Our” refers to the business providing floral goods and services. “Client” refers to the individual, company, organisation or representative placing the order. “Event” refers to the corporate function, activation, conference, workshop, installation or booking for which goods or services are supplied. “Goods” refers to all floral arrangements, bouquets, installations, hired items, vessels, props, structures and related materials supplied. “Services” refers to consultation, design, sourcing, preparation, delivery, setup, styling, on-site adjustments and pack-down. These definitions apply to all written quotes, invoices, online orders and correspondence.

QUOTES AND BOOKINGS

All quotes are valid for 7 days unless otherwise stated. Floral pricing is influenced by seasonality, supplier availability, freight costs and market fluctuations, particularly around peak periods such as Valentine’s Day, Mother’s Day and major public events in Canberra. A booking is confirmed only once the quote has been accepted in writing and the required deposit has been paid. Verbal confirmations do not secure dates. Event dates are allocated on a first-paid basis. We reserve the right to amend pricing if supplier costs increase before a deposit is received. Any changes to scope after confirmation may incur additional charges.

DEPOSITS AND PAYMENT TERMS

A non-refundable deposit of 30–50% is required to secure an event date and cover initial design time, supplier ordering and date reservation. The remaining balance must be paid 7–14 days prior to the event unless otherwise agreed in writing. For large-scale installations or high-value corporate events, earlier final payment may be required to allow procurement of specialty blooms or structural materials. Late payment may result in suspension or cancellation of services. Approved corporate clients may apply for short invoice terms; however, production and delivery may be withheld if accounts are overdue. All payments must be cleared funds prior to delivery or installation.

CANCELLATIONS

Floral work is time-sensitive and perishable. If cancellation occurs more than 14 days prior to the event, the deposit is retained to cover administrative time and preliminary design work, and any remaining balance paid will be refunded. If cancellation occurs 7–13 days prior to the event, 50% of the total invoice is payable due to flower ordering, supplier commitments and labour scheduling. If cancellation occurs within 7 days of the event, 100% of the invoice is payable as flowers and materials will have been purchased and staff allocated. For custom installations, specialty items, imported blooms or custom-built structures, all ordered materials and completed labour are non-refundable.

POSTPONEMENTS

Postponements may be transferred to a new date subject to availability. We will make reasonable efforts to accommodate date changes; however, peak corporate periods in Canberra, including parliamentary sitting weeks and major conference seasons, may limit availability. If flowers or materials have already been ordered for the original date, those costs remain payable. Seasonal price changes may apply if the new date falls in a different supply period. Design substitutions may be necessary if original varieties are unavailable at the postponed time. Additional labour, delivery or reconfiguration costs may apply depending on the revised scope.

AUSTRALIAN CONSUMER LAW

Nothing in these terms excludes rights under Australian Consumer Law. Goods are supplied with guarantees that cannot be excluded, including that products are of acceptable quality and services are provided with due care and skill. Where a major failure occurs, clients may be entitled to remedies in accordance with the law. However, due to the perishable and time-sensitive nature of fresh flowers, change-of-mind refunds are not available. Variations in colour tone, bloom size or natural markings are not considered faults but are inherent characteristics of fresh botanical products.

SUBSTITUTIONS

Flowers are seasonal agricultural products and availability can change daily due to weather conditions, crop quality and supplier shortages. While we make every effort to source requested varieties, we reserve the right to substitute blooms with similar flowers of equal or greater value where necessary. Substitutions will maintain the overall style, scale and agreed colour palette. Exact replication of inspiration images cannot be guaranteed. If a specific flower variety is critical to branding or styling, this must be confirmed in writing at the time of booking and may incur premium sourcing fees.

DELIVERY

Delivery timeframes are estimates unless a fixed delivery time has been agreed in writing. We are not responsible for delays caused by traffic congestion, roadworks, accidents, extreme weather, security restrictions, public demonstrations, or venue-imposed loading schedules. Corporate buildings in Canberra may require advance booking of loading docks or security clearance; this is the responsibility of the client. If delivery cannot be completed due to restricted access, incorrect address details or absence of a recipient, redelivery fees may apply. Risk in the goods passes to the client upon delivery to the nominated address or authorised recipient.

VENUE ACCESS

The client must ensure appropriate and confirmed access to the venue, including loading dock access, lift access where required, parking arrangements and clear bump-in and bump-out times. Access restrictions, security procedures or induction requirements must be disclosed in advance. If access is delayed, restricted or denied, additional labour waiting time and rescheduling fees may apply. We are not responsible for incomplete installations where venue time limitations prevent full setup. Any damage caused by undisclosed site hazards or inadequate access arrangements remains the responsibility of the client or venue.

SETUP AND PACK-DOWN

Setup and pack-down times must be agreed in advance to align with venue schedules and staffing allocations. If access is delayed or extended beyond agreed hours due to venue or client changes, overtime fees may apply. Pack-down will occur at the agreed time unless otherwise arranged. If items cannot be collected due to venue restrictions or client delay, additional collection fees may apply. We are not responsible for items discarded, removed or damaged by venue staff or third parties once the event concludes.

HIRE ITEMS

All hire items, including vases, plinths, stands, arches, candles, vessels and structural components, remain our property at all times. The client assumes responsibility for these items from delivery until collection. Loss, theft, breakage, wax damage, staining, weather exposure damage or misuse will be charged at full replacement cost. Hire items must not be relocated, dismantled or modified without permission. If collection cannot occur at the agreed time, additional hire and labour fees may apply.

FLOWER CARE AND LIABILITY

Flowers are natural products and are sensitive to temperature, humidity, wind, direct sunlight and air-conditioning. Outdoor events, particularly in Canberra’s extreme summer heat or winter frost conditions, may significantly reduce longevity. Once delivered and accepted, responsibility for care transfers to the client. We are not liable for deterioration caused by environmental exposure, lack of water, relocation, or handling by guests or venue staff. Any care instructions provided must be followed to maintain freshness and presentation.

FORCE MAJEURE

We are not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, bushfires, severe storms, government directives, pandemic restrictions, supplier insolvency, transport disruptions or utility failures. In such circumstances, we will make reasonable efforts to reschedule or provide a credit toward a future booking. Refunds will be considered only where costs have not already been incurred for flowers, materials or labour.

LIMITATION OF LIABILITY

Our liability is limited to the value of the goods and services supplied under the relevant invoice. We are not liable for indirect, incidental or consequential losses, including event disruption, reputational damage, loss of revenue or cancellation of third-party services. While every effort is made to meet agreed styling briefs and timelines, minor variations inherent to handmade floral work do not constitute breach. Claims must be made in writing within 24 hours of delivery or event completion.

ONLINE ORDERS

Orders placed through the website must include accurate recipient details, delivery address and contact information. We are not responsible for failed deliveries resulting from incorrect or incomplete information. If no recipient is available, arrangements may be left in a safe place at the driver’s discretion unless otherwise instructed. Redelivery fees apply where delivery must be attempted again. Same-day delivery is subject to order cut-off times and stock availability. Product images on the website are indicative only and may vary based on seasonal supply.

ACCEPTANCE OF TERMS

By confirming a booking, paying a deposit, approving a quote or placing an online order, the client acknowledges that they have read, understood and agreed to these Terms and Conditions. These terms apply to all future transactions unless superseded by a separate written agreement signed by both parties.
